1. Acceptance of Terms

By accessing or using Plantory, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our service. We reserve the right to modify these terms at any time, and your continued use of Plantory constitutes acceptance of any changes.

2. Description of Service

Plantory is an AI-powered garden planning platform that provides:

• Interactive garden design and visualization tools
• Plant database and inventory management
• AI-powered recommendations and chat assistance
• Task planning, scheduling, and notifications
• Photo documentation with EXIF metadata support
• Climate and hardiness zone integration
• Team collaboration features for organizations

3. User Accounts

Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Organizations

You may create organizations and invite team members to collaborate. Organization owners and administrators are responsible for managing member access and ensuring compliance with these terms by all members.

Account Security

You must notify us immediately of any unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. User Content

Ownership

You retain ownership of all content you upload to Plantory, including photos, garden plans, notes, and documentation. Your content remains your intellectual property.

License Grant

By uploading content, you grant Plantory a non-exclusive, worldwide, royalty-free license to store, process, display, and transmit your content solely for the purpose of providing and improving our service.

Content Restrictions

You may not upload content that:

• Is illegal or promotes illegal activities
• Infringes on intellectual property rights of others
• Contains malware, viruses, or harmful code
• Is defamatory, harassing, or abusive
• Violates the privacy rights of others

6. Subscriptions and Billing

Subscription Plans

Plantory offers various subscription plans with different features and usage limits. Details of current plans and pricing are available on our Pricing page.

Trial Period

Trial periods provide full access to paid features for a limited time. No credit card is required to start a trial. At the end of the trial, you may choose to subscribe or continue with limited free features.

Billing

Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these terms.

Cancellation

You may cancel your subscription at any time through your account settings. Access to paid features continues until the end of the current billing period.

Refunds

Refund requests are evaluated on a case-by-case basis. To request a refund, please contact us at support@plantory.ai within 14 days of your purchase.

7. Acceptable Use

You agree to use Plantory in accordance with all applicable laws and these terms. You may not:

• Attempt to access other users' accounts or data without authorization
• Use automated tools, bots, or scrapers to access or collect data from Plantory
• Reverse engineer, decompile, or attempt to extract source code from Plantory
• Use Plantory for commercial resale or redistribution without written permission
• Interfere with or disrupt the integrity or performance of Plantory
• Circumvent any access controls or usage limits
• Use Plantory to transmit spam or unsolicited communications
• Impersonate any person or entity

8. Termination

Termination by You

You may delete your account at any time through your account settings. Upon deletion, we will remove your personal data within 30 days, except where retention is required by law.

Termination by Plantory

We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or for any other reason at our discretion. We will provide notice where possible before termination.

Effect of Termination

Upon termination, your right to use Plantory ceases immediately. We may retain anonymized usage data for analytics and service improvement purposes.

9. Limitation of Liability

Disclaimer of Warranties

Plantory is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Damages

To the maximum extent permitted by law, Plantory and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the service.

Liability Cap

Our total liability for any claims arising from your use of Plantory shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Plantory and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the service, your violation of these terms, or your violation of any rights of another.

11. Changes to Terms

We may modify these Terms of Service from time to time. We will notify you of material changes at least 30 days before they take effect via email or prominent notice on our platform. Your continued use of Plantory after changes take effect constitutes acceptance of the modified terms.

12. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Czech Republic, without regard to conflict of law principles. Any disputes arising from these terms or your use of Plantory shall be subject to the exclusive jurisdiction of the courts located in Prague, Czech Republic.

13. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Plantory regarding your use of our service and supersede any prior agreements.
